Vanguard Orchestral Limited is referred to as “us”, “our” and “we” and is the author and operator of this website. Customers of Vanguard Orchestral Limited are referred to as “you”, “your” or “yours” and agree to be bound by and comply with the terms and conditions contained herein. You must not use this website to browse, purchase products or make bookings if you do not agree to these terms and conditions. We may occasionally make changes to the following information, so we ask that you return and review this page periodically.
1. PRICING
1.1 All prices are inclusive of G.S.T. and are shown in New Zealand dollars.
1.2 Retail product prices on this website are indicative only. We make every effort to keep prices accurate, but due to ever-changing import rates coupled with our large product line and small team, accurate pricing is not always possible.
1.3 Once you have submitted an order, we will confirm the pricing and advise you of any fluctuations in price. The price shown on the final invoice is the price that we will sell to you.
1.4 We aim to be as competitive as possible with our pricing. If you believe our prices are higher than one of our competitors, please contact us and we will review the situation.
1.5 All repair prices on this website are indicative only. They should be read as a rough estimate based on an instrument that has been regularly serviced. We may supply a more accurate quote upon seeing your instrument, but this quote may also fluctuate during servicing based on the unpredictable nature of musical instrument repair. The price shown on the final invoice is the price that we will sell to you.

2. ORDERING PRODUCTS FROM THE WEBSITE
2.1 The goods and services on our website are displayed as an invitation for you to make an offer by submitting an order. We reserve the right to accept or reject your offer, in whole or in part, for any reason whatsoever.
2.2 You may make an offer for goods or services by submitting an order on our website. Your order will then be processed by us and we will confirm the availability and lead time of the goods. If we accept the offer, we will contact you and/or ship the goods to your stated address.
2.3 You agree to provide us with current, complete and accurate details when asked to on our website. We may contact you to ask for additional details.
2.4 Goods on our website will be displayed as either “IN STOCK” or “ENQUIRE NOW!”. We do our best to ensure this is accurate, but in some instances this may be incorrect.
2.5 Not all goods shown on our website are always available. Some unique or less popular items may need to be specially ordered or may be out of manufacture.
2.6 Products are designed to be shipped within New Zealand. If you require your order to shipped overseas, we will decide what to do on a case by case basis.
3. PAYMENT
3.1 Online purchases can be made either using credit card or bank deposit.
3.2 All credit card sales are approved by our secure PCI compliant credit card provider as required by the Security Standards Council.
3.3 If you have made an erroneous payment you should contact us as soon as possible with the details. We will aim to investigate your claim within three working days and refund all or part of your payment if we are satisfied that you have made a genuine payment error.
3.4 Until you have paid for goods in full, ownership will remain with us.
4. FREIGHT
4.1 Shipping costs are included at the time of submitting an online order.
4.2 We will attempt to dispatch all online orders within three working days if the goods are available. We will contact you if there are any issues with this e.g. lack of stock availability.
4.3 We exclusively use signature-required courier to deliver goods within New Zealand. If requested, we will attempt to provide you with a tracking number, however we cannot guarantee this.
4.4 The person receiving the goods is required to sign the package. It is recommended that the goods are inspected before signing. In the unlikely event that you notice damage to the goods, you should refuse the delivery and contact us immediately.
4.5 Goods are examined and are in excellent condition when packed. In the event you notice loss or damage after shipping, you must advise us within 48 hours. We will lodge a claim with the freight company. If you do not advise us within 48 hours, a claim cannot be made.
5. RETURNS, REFUNDS, CANCELLATIONS
5.1 You may cancel an online order providing it has not been shipped.
5.2 If you have placed a “special order” (7) then a cancellation policy will be discussed with you at the start of the transaction on a case by case basis.
5.3 We cannot accept a return of a “special order” product unless the product is faulty or does not conform to the product specifications.
5.4 We will not accept returns on consumable items, for example reeds, which have been removed from sealed packaging.
5.4 We do not have to provide a refund if you change your mind about goods you have purchased, so please choose carefully. We will meet our obligations set out in the Warranty Information section (8) as well as the Consumer Guarantees Act.
6. TRIALS
6.1 Occasionally, we will bring in goods from other New Zealand stores for you to trial at your request.
6.2 You agree to pay a shipping fee associated with collecting goods for your trial unless arranged otherwise. This fee is payable in advance and will be invoiced to you. If your trial results in you purchasing the goods, the shipping fee will be deducted from the final invoice.
7. SPECIAL ORDERS
7.1 A “special order” product includes but is not limited to:
7.1.1 Goods shown on our website that require custom fabrication.
7.1.2 Goods not shown on our website which are fabricated or sold by a manufacturer or wholesaler we work with.
7.1.3 Goods shown on our website which we consider not viable to be kept regularly in stock.
7.2 You are required to pay 50% of the purchase price up-front for any special orders unless arranged otherwise. This deposit is non-refundable. You will be issued a receipt for your deposit and we will establish the special order.
7.3 We will make every effort to give you an accurate timeframe for the delivery of your order. However, this is an indication and not a guarantee of delivery on a certain date. You are subject to changes from manufacturing, freight, global policy changes (e.g. Covid-19) etc.
8. WARRANTY INFORMATION
8.1 Vanguard Orchestral Limited warrants that goods will be free from material and/or manufacturing defects.
8.2 New goods are covered by a full twelve (12) month warranty from the date of purchase.
8.3 Used goods are covered by a full ninety (90) day warranty from the date of purchase.
8.4 Our liability under a warranty claim is to repair or replace the goods.
8.5 The warranty is extended to the original purchaser of the goods and does not extend to subsequent owners.
8.6 You must retain your invoice and present it as proof or purchase to be covered by warranty.
8.7 Any service or repairs provided or attempted by anybody other than Vanguard Orchestral Limited are done at your own risk and will void the warranty.
8.8 Warranty does not cover:
8.8.1 Damage resulting from accident, misuse, neglect, spills, temperature, humidity, corrosion, mould or liquid.
8.8.2 Goods that have been modified or altered in any way.
8.8.3 Consumable goods, such as reeds, that have been removed from sealed packaging.
8.9 New musical instruments purchased include a service guarantee within six (6) months of the purchase date, i.e. we will accept a service booking for the instrument and make any adjustments and repairs necessary which fall within what we deem to be normal wear and tear.

The information on this Website is subject to change without notice. Whilst every effort has been made to ensure the site’s accuracy, Vanguard Orchestral Limited will not be liable for any inaccuracies in the information contained herein, except where provided for by the Consumer Guarantees Act.
